PRIVACY POLICY

Athletica L.L.C. ("Athletica," "we," "us," or "our") is committed to protecting the privacy of all individuals who visit and use www.athleticagrp.com, including youth athletes, their families, and brand partners. This Privacy Policy explains what information we collect, how we use it, how we protect it, and your rights regarding your personal data.

MINORS: Athletica works with athletes as young as 13. We take the privacy of Minor athletes especially seriously and do not knowingly collect data from children under 13 without verified parental consent.

1. INFORMATION WE COLLECT

 

1.1 From Athletes & Families

We collect information you provide when submitting an athlete application, signing a service agreement or media release, creating an account, purchasing products or services, or contacting us. This may include: full name, date of birth, email, phone number, mailing address, athletic information (sport, team, position, club, school), social media handles, payment information, and communications with Athletica.

 

1.2 From Brand Partners

When a brand registers, submits a listing, or contacts Athletica regarding the Brand Partnership Program, we collect: company name, contact name and title, business email address, phone number, website, brand category, opportunity details, budget information, and any content submitted as part of a listing (logos, images, descriptions).

We also collect payment information for listing package purchases, processed securely through our payment provider. We do not store full credit card numbers.

 

1.3 Information Collected Automatically

When you visit our Site, we automatically collect IP address and device identifiers, browser type and operating system, pages visited and time spent, and referral URLs. This data is collected via cookies and similar technologies managed through our Wix.com hosting platform.

 

1.4 Information from Third Parties

We may receive information from: Wix.com (our website platform), Printful (merchandise fulfillment), payment processors, social media platforms, and NIL marketplaces where we list athletes under Agency Representation agreements.

 

2. HOW WE USE YOUR INFORMATION

 

2.1 Athlete & Family Data

We use athlete and family data to provide and deliver requested services, process payments, communicate about sessions and deliverables, publish athlete content as authorized by signed media releases, list athletes on NIL marketplaces under Agency Representation, and connect athletes with brand opportunities through the Brand Partnership Program.

 

2.2 Brand Partner Data

We use brand partner data to process and review listing submissions, display approved listings on the Opportunities Board, match brands with appropriate athletes, facilitate introductions and communications between brands and athletes, process listing package payments, send relevant updates about the Brand Partnership Program, and improve our matching and platform services.

We will not use brand partner contact information to send unsolicited marketing communications unrelated to the Brand Partnership Program without your consent.

 

3. HOW WE SHARE YOUR INFORMATION

 

3.1 Between Athletes and Brands

The Brand Partnership Program requires sharing certain information between athletes and brands to facilitate partnerships. Specifically:

  • Approved brand listings (company name, opportunity description, compensation, contact method) are displayed publicly on the Opportunities Board

  • When Athletica facilitates an athlete-brand introduction, the athlete's name, sport, social media handles, and relevant athletic information may be shared with the brand

  • Under Pro and Elite listing tiers, Athletica screens athletes before making introductions — brands do not receive athlete contact information until Athletica has coordinated the introduction

  • Athlete personal contact information (direct phone, personal email, home address) is never shared with brands without the athlete's explicit consent and, if a Minor, parental consent

 

3.2 Service Providers

We share information with trusted third-party vendors including Wix.com (hosting and payments), Printful (merchandise fulfillment), and communication providers. These vendors are contractually obligated to protect your data.

 

3.3 NIL Marketplaces

Under Agency Representation (Tier 3), we may share athlete information with NIL marketplace platforms for athlete listing and brand matching. This is done only under a signed Agency Representation Agreement authorizing us to do so.

 

3.4 Legal Requirements

We may disclose information if required by law, court order, or governmental authority, or to protect the rights, property, or safety of Athletica, our clients, or the public.

 

3.5 What We Never Do

  • We never sell personal information of athletes, families, or brand partners to third parties

  • We never share Minor athlete contact information with brands without parental consent

  • We never publish athlete content without a valid signed media release

  • We never share brand payment or financial information with athletes or third parties

 

4. ATHLETE CONTENT & DOCUMENTARY EPISODES

Content captured by Athletica is subject to the signed media release. Athletica may use athlete images and video in its portfolio, website, social media, and promotional materials. Documentary episodes are published on the Athletica Originals YouTube channel. Athletes and parents may request content removal by contacting benny@athleticagrp.com — removal requests are reviewed within 14 business days. Content already distributed to third-party platforms may not be fully retractable.

 

5. BRAND PARTNER LISTING DATA

Approved brand listings are displayed publicly on the Athletica Opportunities Board and may be visible to all site visitors including athletes, families, coaches, and the general public. Brands should only include information in their listings that they are comfortable making publicly available. Brands may request removal of their listing at any time by contacting benny@athleticagrp.com, though listing fees are non-refundable as specified in these Terms.

 

6. COOKIES & TRACKING

Our Site uses cookies to maintain sessions, analyze traffic, and support payment processing. You may control cookie settings through your browser. Our Site is hosted on Wix.com, which may set its own cookies per Wix's Privacy Policy.

 

7. DATA SECURITY

Athletica employs industry-standard security measures including SSL encryption and firewall protection through our Wix.com hosting platform. Payment processing complies with PCI-DSS standards. No internet transmission is 100% secure, and while we strive to protect your data, we cannot guarantee absolute security.

 

8. DATA RETENTION

  • Athlete session and service records: Minimum 3 years after service completion

  • NIL representation records: Duration of agreement plus 5 years

  • Brand partner listing and agreement records: 3 years from listing expiration

  • Payment records: As required by applicable tax and financial regulations

  • Marketing communications: Until you opt out or request deletion

 

9. YOUR RIGHTS

You may have the right to access, correct, or delete your personal information, opt out of marketing communications, and request restriction of data processing. To exercise these rights, contact benny@athleticagrp.com or call/text 1 (952) 994-6727. We will respond to verified requests within 30 days.

 

10. CHILDREN'S PRIVACY

Athletica does not knowingly collect personal information from children under 13 without verifiable parental consent. For athletes between 13 and 17, a parent or guardian must sign all service agreements and media releases. Brand partners are prohibited from directing marketing or partnership opportunities to athletes under 13. We do not publish identifying personal information about Minor athletes beyond what is authorized in the signed media release.

 

11. BRAND PARTNERS & CHILDREN'S PRIVACY

Brand partners who post opportunities through Athletica acknowledge that some athletes in the Athletica network are Minors. Brands agree to:

  • Not market age-restricted products (alcohol, tobacco, gambling, adult content) to Minor athletes

  • Obtain verified parental consent before executing any agreement with a Minor athlete

  • Not communicate directly with Minor athletes without Athletica's coordination and parental awareness

  • Comply with all applicable children's advertising and privacy laws including COPPA

 

12. THIRD-PARTY LINKS

Our Site may contain links to third-party websites including NIL marketplaces, social media platforms, and brand partner websites. Athletica is not responsible for the privacy practices of these sites. We encourage you to review their privacy policies.

 

13. CHANGES TO THIS POLICY

We may update this Privacy Policy at any time. Changes will be posted with a revised effective date. Material changes will be communicated by email or prominent Site notice. Continued use of the Site after changes constitutes acceptance of the revised Policy.
